After being threatened and seeing how the crime claimed her cousin’s life, a Colombian woman decided to flee illegally with her 4-year-old daughter to Costa Rica in December 2013.
Since then, they have been involved in judicial processes which apparently ended in February. In 2016 a Court of Justice ordered the girl to return to the South American country, as her father had filed a petition for the child’s abduction and the judges reproached her illegal entry to Costa Rica.
However, the Constitutional Court ruled in favor of the mother and her daughter who, after 4 years in the country, were developing their life in national territory. The girl wanted to stay and after surpassing dramatic moments, the Court put an end to an imminent return to Colombia.
The Constitutional Court analyzed the case and considered as key factor the fact that the girl has grown in the country under the right conditions. In fact, the girl expressed her desire to remain in Costa Rica and the entity ruled in favor of the child, who is now 8 years old.
