Attorney General and Magistrate Gamboa finally face criminal complaints

Attorney General Jorge Chavarría and Celso Gamboa, a magistrate of the Third Chamber, were indicted by the National Association of Criminal Investigators (ANIC) before the Supreme Court of Justice.

Álvaro Rodríguez, secretary general of ANIC, confirmed that the complaint was raised on October 11th at 3:00 p.m. for the alleged crime of influence peddling and breach of duties.

The complaint is based on the case of the cement and the rejection -despite the evidence- of a complaint filed since 2015 against legislators Víctor Morales Zapata, from the Citizen Action Party (PAC) and Otto Guevara, from the Libertarian Movement (ML).

At the end of 2015, the deputy prosecutor, Berenice Smith Bonilla, gave the order to dismiss the complaint after an order given by Chavarría as head of the Public Prosecutor’s Office.

In February this year, the Third Chamber, with the presence of Gamboa, signed the dismissal of the case.

In the criminal complaint, ANIC also refers to the alleged coincidence in the trip made by Gamboa and the Chinese cement importer, Juan Carlos Bolaños Rojas, to Panama in October 2016.

On Wednesday, CRHoy.com reported that the prosecution, headed by Chavarria and Smith, ignored a request by the Judicial Investigation Agency (OIJ) and ordered the Third Chamber to dismiss an investigation against several legislators, who would have had ties with Bolaños Rojas.

The OIJ revealed the existence of multiple telephone contacts between Bolaños and legislatos Víctor Morales Zapata, Otto Guevara, and the former legislator Walter Céspedes -chief of advisers to the PUSC legislators in the Legislative Assembly.
