This seems unusual, but it is true. The Constitutional Court of Colombia protected workers so that they can get to work under the effects of alcohol or drugs and manage to work without affecting their routine.
The ruling has caused controversy in the country, which in recent years has rebounded cocaine production and consumption.
The Colombian Court has reinterpreted a part of an article in the Labor Code that explicitly prohibits going to work under the influence of narcotics, alcohol or unhealthy drugs.
According to the Court’s argument, these substances do not always hinder performance in daily work.
However, the court sets exceptions for activities that involve risks for the worker, co-workers or for third parties.
No disciplinary measures can be taken if the employer does not proof the negative impact that the use of psychoactive substances has on the person’s work,
the ruling warned.
