Constitutional Chamber notified resolution on same-sex marriage

On January 28th, the Constitutional Chamber notified the parties involved in one of the resolutions through which same-sex marriage was legalized.

The lawyer Yasín Castrillo filed this appeal in 2013. He intended to repeal the articles that prevented marriage between two men or two women. The magistrates ruled in favor on August 8th, 2018.

Through this action, the magistrates declared unconstitutional article 242 of the Family Code and subsection m, of article 4, of the Law of the Young Person. In addition, they urged legislators to adapt the national legal framework with the purpose of regulating the scope and effects derived from de facto unions between same-sex couples.

The magistrates gave 18 months so that the articles that prevented same-sex marriages are repealed. This term began to run from last November 26th.
