The Labor Court of Appeals of the First Judicial Circuit of San José determined the strike in the National Board of Children (PANI) is legal.
The ruling issued on Monday indicates that the strike qualification proceedings were declared null and void.
One of the reasons that weighed in the analysis of the appeal was that the workers only participated in the movement for three days,
and they did not violate the principle of proportionality, because the message of social discontent was transmitted effectively during the first three days of the movement and then they returned to their jobs (as reported by the employer),”
says the sentence.
The certification issued by the coordinator of the Human Resources Department of the PANI certified that the institution’s employees participated in the strike called by ANEP only on September 10th, 11th and 12th and, as of the 13th of the same month, they resumed their work.
