The Southern Development Board (JUDESUR) won an appeal that allows them not to transfer funds to build a landfill.
The Constitutional Court rejected the appeal lodged by the Federation of Municipalities of the South (FEDEMSUR) regarding the funds they demanded from JUDESUR.
According to the resolution, FEDEMSUR must comply with the environmental law in force before demanding public funds.
This case dates back to 2014, when the FEDEMSUR developed a project for the construction of a landfill that would be used by the municipalities of Buenos Aires, Osa, Golfito, Corredores and Coto Brus, since dump pits are technically forbidden by the Ministry of Health.
However, the entity did not comply with 12 requirements requested by the responsible environmental manager of the project. Therefore, to this date JUDESUR has not transferred the money, despite the budget approval by the Comptroller General of the Republic in 2015.
JUDESUR is currently working on a comprehensive proposal to solve the issue of landfills in the 5 counties of the south, allocating economic resources and technical support from the Department of Development.
