The Constitutional Chamber rejected a writ of habeas corpus raised so that Juan Carlos Bolaños could serve at home the six-month prison sentence imposed on him for the Chinese cement scandal.
The Chamber indicated that his right to health was violated, but that he will remain in custody where he is,”
said his lawyer Fernando Vargas.
On February 4th it was established that both Bolaños and the suspended general manager of the Bank of Costa Rica (BCR), Mario Barrenechea, will be behind bars for another six months. Likewise, Andrés Víquez Lizano and Leonardo Acuña, assistant managers of the bank, will remain in prison.
Bolaños’ lawyers assured that their client has been mistreated by Social Adaptation and that Juan Carlos Bolaños is the only person in Costa Rica to be arrested for having debts.
According to the defenders of the Chinese cement importer, neither the Public Ministry nor the Judicial Investigation Agency have carried out any investigation, and their client was imprisoned with a report from the Superintendence of General of Financial Entities (SUGEF) that was made from a contract that was not valid.
Additionally, they added that there are allegations of the judges based on conjecture. Therefore, they are analyzing the idea of accusing them before the Judicial Inspection or even filing a criminal appeal. However, before proceeding, they will wait to hear the resolution of the precautionary measures hearing that will be resolved today.
According to Vargas, if they achieve their goal that their client is released, they would be analyzing the measures. His other lawyer, Juan Marcos Rivero, said that they are preparing a writ of amparo to present before the Constitutional Chamber and compel the State to pay for a new surgery for Mr. Bolaños.
