The Criminal Cassation Chamber of the Supreme Court upheld the dismissal of a case against the Minister of the Presidency, Sergio Alfaro Salas, for alleged illegal appointments while serving as chief executive of the National Insurance Institute (INS).
Alfaro, appointed Minister in April of 2015, was reported for apparently naming a person in the INS who did not meet the requirements. However, this was discredited during the investigation by the Attorney General’s Office.
The case was opened for the crime of illegal appointments. The Office of the Attorney General studied the complaint and after the legal analysis the case was dismissed,”
said a statement by the Supreme Court.
Carlos Chinchilla, president of that Chamber, explained that the dismissal was made because the crime requires the configuration of fraud (deliberate will), but this is not the case.
According to the investigation, the technical report given to Alfaro to endorse the appointment had a positive assessment.
