Otto Guevara, legislator from the Libertarian Movement said on Monday that the bill to extinguish dominion, which would allow removing assets from the drug trade, contains “serious defects”, so he presented more than 100 motions against it.
The legislator pointed out that the initiative violates the constitutional principle of innocence, invalidates the burden of proof, confiscates property of people without the need for a trial and violates private property.
Guevara said that the director of the Public Defense, Marta Iris Muñoz, expressed concerns at a hearing in the Committee on Government and Administration of the Legislative Assembly.
On that occasion, Muñoz said that the proposal violates fundamental rights protected in the Constitution and international instruments.
According to Muñoz, the scope of the bill is too broad and includes, as a budget for seizure in favor of the State, any illegal activity regardless of whether or not it relates to drug trafficking, and provides the possibility of extinguishing legal assets acquired in good faith.
The Public Defense says it violates principles such as the consolidated legal situation, acquired rights, the doubt in favor of the administered and in general due process.
The proposed legislation, which could soon be put to the vote, will allow the state to remove property and money illegally obtained from organized crime.
