The Contentious Administrative Court of the Treasury filed a lawsuit from the Association of Free Consumers (ACL), which aims to declare the vehicle ownership Tax unfair and unlawful. In addition, it wants the State to assume the cost of damages for having applied a possible mistaken estimation.
This was explained by the organization in a statement released on January 3rd.
In addition to this tax collective lawsuit, in early 2017, ACL promised to submit an action of unconstitutionality to the Constitutional Court against laws 7088 and 7665, in which it was created the formula set to calculate the values of vehicles for tax purposes.
This tax was illegitimately indexed during the processing of a Central American treaty related to textils and paper. Besides, the tax was created for a ‘progressive collection,’ where the person who has higher value goods will pay more taxes,
stated the Association .
In its opinion, the application of the regulations has meant the unlawful appreciation of the values of vehicles used for tax purposes, and violates the Constitutional Principle of Justice and Tax Reasonability.
