A few hours after the agreement that ended the strike in health services, a citizen filed an amparo appeal because they feel this document violates the principles of legal reserve and creates an unjustified advantage in favor of the employees of the Costa Rican Social Security Fund (CCSS).
The lawyer Yashín Castrillo, resorted to the Constitutional Chamber and explained that the Law on Strengthening of Public Finance established a series of restrictions and rules for the purpose of cleaning up finances; among them, that all public employees submit to the calculation of bonuses nominally, not by percentage, but the agreement signed by the parties on Monday night establishes otherwise.
In the same line, the appellant states that in the agreement
there is no reason to justify this inequality between the officials of the Fund and all other public officials.”
The lawyer points out that the agreement between the parties sets a bad precedent that could motivate other institutions to strike and ask for exceptions.
